Terms and Conditions

Welcome to Milefoto. These Terms and Conditions (“Terms”) govern the provision of photography services by Milefoto to clients. By booking or using our services, you agree to be bound by these Terms.

1. Services

We provide professional photography services, including but not limited to event photography, portrait sessions, commercial photography, and more. Specific services, pricing, and deliverables will be outlined in a written agreement or contract prior to the commencement of services.

2. Booking and Deposits

To secure our services for your event or session, we require a signed contract and a non-refundable deposit of 10% of the total service fee. The deposit confirms your booking and holds the date for your event or session. The remaining balance must be paid on the day of the photography session.

3. Pricing and Payment

All pricing will be clearly outlined in our contract or proposal. Payments can be made via payment methods listed in the invoice. Late payments may incur a fee of 5% per day after the due date. We reserve the right to suspend or cancel services if payments are not received in full as outlined.

4. Cancellation and Rescheduling

• Client Cancellation: If you cancel the services, the deposit is non-refundable. If cancellation occurs 15 days before the event, 50% of the total fee will be due.

• Rescheduling: Rescheduling is permitted based on availability and must be done at least 15 days in advance.

• Weather-Related Rescheduling: For outdoor sessions, rescheduling due to weather conditions is at the photographer’s discretion and subject to availability.

5. Image Rights and Usage

• Client’s Use: You are granted a personal, non-commercial license to use the photographs for your own personal purposes, including sharing on social media or printing. For any commercial use or reproduction, prior written consent is required.

• Photographer’s Use: We reserve the right to use the photographs for portfolio purposes, marketing, advertising, and on social media, unless otherwise agreed upon in writing.

• Model Release: By hiring our services, you grant us permission to use images that include you, your event, or your likeness for promotional purposes, unless a written request is made to restrict this use.

6. Copyright

All images produced by Milefoto are protected by copyright law. We retain the full copyright to all images, unless otherwise transferred in writing. Clients are not permitted to edit, alter, or resell the images without prior written consent.

7. Image Delivery

Final images will be delivered within 7-15days of the event/session unless otherwise agreed upon. Images will be delivered via a downloadable link. Any additional retouching requests may incur an additional fee.

8. Limitations of Liability

• Service Performance: We will make every effort to provide high-quality services. However, we cannot guarantee specific outcomes or results from a photoshoot or event.

• Unforeseen Circumstances: In the event of illness, injury, or other circumstances beyond our control that prevent us from delivering the agreed services, we will notify the Client as soon as possible. We reserve the right to find a substitute photographer or offer a full refund of all fees paid, including the deposit.

• Liability: Our liability for any claim, including loss or damage resulting from our services, is limited to the amount paid by the Client for the services. We are not liable for incidental, consequential, or special damages of any kind.

9. Force Majeure

Neither party will be liable for any delay or failure to perform obligations under this agreement due to events beyond their reasonable control, including but not limited to natural disasters, government restrictions, pandemics, and acts of terrorism.

10. Client Responsibilities

The Client is responsible for:

• Providing accurate and timely information about event details and schedules

• Securing any necessary permits for photoshoots at specific locations

• Ensuring all parties involved in the photography sessions are on time and prepared

• Notifying us of any specific requests or preferences prior to the session or event

11. Governing Law

These Terms shall be governed and interpreted in accordance with the laws of the State of Texas. Any disputes arising from these Terms or our services will be resolved in the courts located in [Insert County], Texas.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of the Terms, which will remain in full force and effect.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Any changes will be effective upon posting the updated Terms on our website. We encourage you to review these Terms periodically.
